Daughters can inherit property held by joint family, rules HC

A full bench of the Bombay High Court said the 2005 amendment to the Hindu Succession Act, 1956 was retroactive in nature and would apply to all daughters born after 1956 and alive in 2005. The Act granted daughters in a Hindu joint family the same right of inheritance as that of a son.

In their 72-page judgement, the court also stated, “the heirs of daughters who died before 9 September 2005 do not get the benefits of the amended Section.”
